Dr Roger Moore has been providing legal reports for over 25 years, since graduating with a Master’s degree in laws from Cardiff University (Legal aspects of Medical practice) back in 1992.

Both the Dental Defence Union and the Dental Protection society have and continue to routinely instruct Dr Moore to defend their members against negligent claims. Approximately half of his time is spent working for patients who have a claim for poor / sub standard work provided by dentists. In the last 12 months, Dr Moore has been instrumental in the success of many cases where he has acted as the dental expert in negligence cases. The highest award gained has been well in excess of £100,000 relating to a foreign object dropped into a patient’s lungs.

Over 50 cases of personal injury are also performed each year. Dr Moore regularly receives instructions from various legal agencies, including Premex, Doctors Chambers, Speed Medical, Lawyers Medical Agency and UK Ind Medical. The range of issues covered in personal injury reports range from the minimal, biting on a stone in a cereal bar and fracturing a cusp of a tooth, to the extreme where a claimant being hit in the face with a brick and requiring a hemi maxillectomy, after being in a coma for many months.

Negligence

The advantage of having a masters degree in law, specifically in “Legal Aspects of Medical practice” is that the issues of both clinical and legal matters are well understood. While some dental care may be poorly provided, understanding how they relate to a claim in negligence is important. With over 25 years of experience, backed by post graduate qualifications in general dental practice, implant dentistry and the law, allows Dr Moore to write “breach and causation” as well as “condition and prognosis” reports that reflect the facts of the case and the remedial solutions required.

 

Personal Injury

Personal injury cases are subtly different to negligence cases, but require a sound knowledge of dentistry and the long term issues caused by trauma / personal injury.

Dr Moore routinely prepares reports from small cases, such as trips on pavements causing chipping to upper front teeth, to very complex cases where the claimant has had life threatening and very debilitating injuries.

The most complicated claim for personal injury related to a patient who was hit in the face while driving his car by a brick that fell off the back of a skip. He lost the left side of his face and was in a coma for many months. The dental report required an assessment of the loss of the left maxilla and the necessary surgery to try and improve the situation by providing dental implants and an obturator. The claim was settled for well over £250,000, the dental component being in excess of £150,000.
